Jefferson City – Defaced Firearm, Resisting Arrest, Stolen Property…FREE TO GO under New Missouri Supreme Court Rules

Jaquan Whirley, of Jefferson City, was arrested and charged with possession of a defaced firearm, resisting arrest, receiving stolen property, and motor vehicle infractions following a traffic stop on December 27, 2019.

According to the police probable cause statement and the News Tribune

While patting Whirley down, an officer reportedly found Whirley had a handbag on the inside of his shirt. The officer believed Whirley was carrying a firearm in the bag.

When the officer went to remove the bag from Whirley, Whirley began to pull away and run from the officer. The officer was able to take Whirley to the ground and secure the weapon that was in the bag.

The firearm was found to have been stolen from Boone County. Whirley allegedly admitted to buying the weapon for $50 from a man he didn’t know.

Whirley was later released and FREE TO GO after a judge released him on his own recognizance under new Missouri Supreme Court rules that went into effect July 1, 2019 which have stripped judges of the judicial discretion to set bail by forcing “catch & release” policies.

The release is yet another example of the thousands of unaccountable releases taking place in Missouri due to relaxed court rules by the Missouri Supreme Court that were implemented in July of 2019.
