Miller County Accused Rapist FREE TO GO under New Missouri Supreme Court Rules

Darryl Elmore, 32, of Miller County, was arrested and charged last week with 1st degree rape or attempted rape, 2nd degree kidnapping, and 2nd degree domestic assault after authorities responded to a call at a residence in the Kaiser area. Police responding to the call had to force entry into the home during the assault to arrest Elmore.

According to Boonville Daily News

“The victim was taken to Lake Regional Hospital for treatment.”

“According to deputies, the victim alleged it was not the first time she had been assaulted or threatened by Elmore. He had treatened to take her phone if she tried to call for help. During the assault that lead to his arrest, the victim said he choked her, hit her and forced himself on her.”

Elmore was later released and FREE TO GO after a judge released him on his own recognizance under new Missouri Supreme Court rules that went into effect July 1, 2019 which have stripped judges of the judicial discretion to set bail by forcing “catch & release” policies.

This is certainly not Elmore’s first run in with the law…having been arrested for driving while intoxicated, possession of drugs, failing to appear for court and other charges.

The release is yet another example of the thousands of unaccountable releases taking place in Missouri due to relaxed court rules by the Missouri Supreme Court that were implemented in July of 2019.

“A Kaiser man accused of rape, kidnapping, and domestic assault receives an early Christmas present. 32-year old Darryl Elmore has been released from jail on his own recognizance. Authorities claim they heard screams for help coming from a home on Mahagony Road December 16th. When they forced entry into the home, it’s alleged that they observed Elmore climbing off of the alleged victim. He’ll be back in court December 27th for a case review.”
